Move-Away Custody

Move-Away Custody in San Diego

Plan a Relocation Around Your Child’s Stability

Relocation involves more than changing an address. It can affect transportation, school arrangements, parenting schedules, and the child’s relationship with each parent. Shorb & Connor LLP helps San Diego parents assess these concerns and prepare for the custody issues created by a planned move.

A move-away dispute concerns a proposed change to a child’s primary home that affects an existing or requested custody arrangement. These disputes can arise before an initial custody order or when a parent requests a modification after judgment. The appropriate steps depend on current orders, the destination, any required notice, and the effect on the existing schedule.

Whether you’re planning to relocate or seeking to prevent a move, the central question is how the child can maintain stability and meaningful relationships. We develop an individualized strategy around the applicable custody order, the reasons for the planned move, and a workable schedule if relocation occurs.

Discuss your move-away custody concerns directly with an attorney. Call (619) 330-0938 to arrange a complimentary strategy session.

How California Law Applies to Move-Away Cases

California Family Code section 7501(a) provides that a parent entitled to custody may change the child’s residence, subject to the court’s authority to restrain a removal that would prejudice the child’s rights or welfare. How that rule applies depends heavily on whether one parent has primary custody or the parents share custody.

Sole Physical Custody & the Burgess Standard

Under In re Marriage of Burgess, a parent with primary physical custody may generally relocate with the child unless the court determines that the move would prejudice the child’s rights or welfare. The parent opposing the move must first show that relocation would cause detriment to the child. If that threshold is met, the court considers whether changing custody would serve the child’s best interests.

The label in an order doesn’t always resolve the analysis. The court may consider the actual arrangement, including how the child divides time between households. We review both the existing order and how the schedule functions in practice before advising a parent about the applicable standard.

Joint Physical Custody & a New Best-Interest Determination

When parents share custody, the Section 7501 presumption doesn’t apply in the same manner. The court instead conducts a new best-interest determination regarding the arrangement. Section 3020 also reflects California’s policy that children should have frequent and continuing contact with both parents when that contact is consistent with their best interests.

This distinction can shape the evidence and requested orders in a child relocation custody dispute in San Diego. A long-distance schedule may need to address school-year parenting time, holidays, breaks, virtual contact, and transportation. Each parent should be prepared to explain how the suggested arrangement supports the child’s continuing relationship with the other parent.

What Courts Consider in a Child Relocation Dispute

In re Marriage of LaMusga identifies considerations that can inform a court’s fact-specific analysis. No single factor determines every case. The weight of each issue depends on the child, the current arrangement, and the practical effects of relocation.

The court may consider:

  • The child’s interest in stability and continuity
  • The distance of the proposed move and the child’s age
  • The child’s relationship with each parent
  • Each parent’s ability to communicate and cooperate
  • The reasons offered for the proposed relocation
  • The parents’ current custody and parenting-time arrangement
  • The wishes of a child who’s sufficiently mature for those views to be considered

Relevant information may include current calendars, school records, transportation details, communications between the parents, and a realistic schedule. A parent requesting relocation should be ready to explain how the child’s education, daily routine, and contact with the other parent would be addressed. A parent opposing it should identify specific effects on the child, rather than relying only on the understandable difficulty the change would create for the parent.

How San Diego Move-Away Custody Cases Proceed

We begin by learning what’s happening, what orders are in place, and what you want to accomplish. We then explain the available paths, which may include negotiating an agreement, preparing for Child Custody Recommending Counseling, or presenting unresolved issues at a hearing. We also advise clients about the San Diego Superior Court location and procedures that may apply to their family law matter.

Notice, Negotiation & Court Requests

A parent considering relocation should obtain advice before changing the child’s residence or disrupting the established schedule. Notice requirements and the appropriate court filing depend on the existing orders and circumstances. Acting early gives both parents time to evaluate transportation, school arrangements, and possible revisions to parenting time.

Some parents can resolve a proposed move through a written agreement and appropriate court orders. When they can’t agree, one parent may ask the court to obtain or modify a custody order. California Family Code section 3170(a) generally requires contested custody and visitation issues raised in such a pleading to be set for mediation.

Child Custody Recommending Counseling

In San Diego, covered disputed custody and visitation matters proceed through Child Custody Recommending Counseling with Family Court Services. This isn’t solely a confidential mediation process. If the parents don’t reach an agreement, the counselor prepares a written recommendation for the judge.

Under California Family Code section 3183(a), a child custody recommending counselor may submit a custody or visitation recommendation after providing it in writing to the parties and their attorneys before the hearing. We prepare clients to communicate their plan, child-centered concerns, and practical details clearly.

Custody Evaluations & Hearings

In a contested move-away case, the court may appoint a neutral custody evaluator under Section 3111. The evaluator investigates the family’s circumstances and provides a written recommendation to the court. Whether an evaluation is ordered depends on the issues and the court’s assessment of the information needed.

If issues remain unresolved, the judge may consider testimony, documents, the Child Custody Recommending Counseling recommendation, and any ordered evaluation. We prepare clients for each stage while grounding the requested plan in the child’s welfare and the practical realities of relocation.
